Terms of Service

Definitions

• "Application" or "Specimen" refers to the Specimen font manager software
• "enSili.co," "we," "us," or "our" refers to the company enSili.co, located at C/Ganivet, Granada, Spain
• "You" or "User" refers to the individual or entity using Specimen
• "License" refers to the right to use Specimen granted under these terms

License Grant

Subject to your compliance with these Terms, enSili.co grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use Specimen for your personal or commercial use.

License Terms:

• Single User License: Each license permits installation and use on up to 3 Macs owned or controlled by the licensee
• Trial Version: The trial version provides full functionality for a limited evaluation period
• Updates: Your license includes free updates to Specimen during the version cycle (e.g., 1.x updates)
• Ownership: This is a license, not a sale. enSili.co retains all rights to Specimen

Acceptable Use

You agree to use Specimen only for lawful purposes. You may NOT:

• Reverse engineer, decompile, disassemble, or attempt to derive the source code of Specimen
• Modify, adapt, translate, or create derivative works based on Specimen
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices
• Rent, lease, lend, sell, redistribute, or sublicense Specimen
• Share your license key or provide access to others not covered by your license
• Use Specimen for any illegal purpose or in violation of any laws
• Circumvent any technical limitations or copy protection mechanisms

Font Licenses

Important: Specimen is a tool for managing fonts. You are solely responsible for ensuring you have proper licenses for all fonts you use with Specimen. We do not provide font licenses, and using Specimen does not grant you any rights to fonts.

• Comply with all font licenses and terms of use
• Only install and use fonts you have legally acquired
• Respect copyright and intellectual property rights of font creators

Google Fonts and Fontshare integration allows you to browse and install fonts under their respective licenses. You must comply with those licenses when using such fonts.

Payment & Refunds

Purchases via Mac App Store:

Purchases through the Mac App Store are subject to Apple's terms and refund policies. All refund requests for App Store purchases must be directed to Apple.

Direct Purchases via Paddle:

Direct purchases are processed by Paddle.com Market Limited, our Merchant of Record. When you purchase directly:

• Prices are listed in USD; your payment method may be charged in your local currency
• You will receive a license key via email after successful payment
• All sales are final except as described in our refund policy below

30-Day Refund Policy:

We offer a 30-day money-back guarantee for direct purchases. You may request a refund if:

• Specimen does not perform as described
• You experience technical issues that we cannot resolve
• You are unsatisfied for any reason within 30 days of purchase

To request a refund, contact us at hello@ensili.co with your order details. Please allow 5-7 business days for refund processing.

Software Updates

We may provide updates, upgrades, or modifications to Specimen. Updates may:

• Add new features or functionality
• Fix bugs or improve performance
• Modify or remove existing features
• Change system requirements

We are not obligated to provide updates, but when we do, they are covered by these Terms. We recommend keeping Specimen up to date for security and compatibility.

System Requirements

Specimen requires macOS 13.5 (Ventura) or later. We do not guarantee compatibility with future macOS versions, though we strive to maintain compatibility through updates.

Disclaimer of Warranties

Specimen is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied.

To the maximum extent permitted by law, enSili.co disclaims all warranties, including but not limited to:

• Implied warranties of merchantability and fitness for a particular purpose
• Warranties that Specimen will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy or completeness of content
• Warranties that Specimen will meet your specific requirements

Some jurisdictions do not allow exclusion of implied warranties, so these limitations may not apply to you.

Limitation of Liability

To the maximum extent permitted by law, enSili.co shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use.

This includes but is not limited to damages arising from:

• Your use or inability to use Specimen
• Any bugs, errors, or interruptions in Specimen
• Loss or corruption of data
• Unauthorized access to your system
• Any third-party content or services accessed through Specimen

Our total liability for any claims related to Specimen shall not exceed the amount you paid for your license, or $29 if purchased directly from us.

Some jurisdictions do not allow limitation of liability for incidental or consequential damages, so these limitations may not apply to you.

Data Backup

You are responsible for maintaining backups of your data. While Specimen includes features to organize and manage fonts, we strongly recommend:

• Regular backups of your font library using Time Machine or other backup solutions
• Keeping original copies of purchased or licensed fonts
• Not relying solely on Specimen's organization for font safety

We are not responsible for any data loss that may occur while using Specimen.

Termination

This license is effective until terminated. We may terminate your license immediately if you breach these Terms. Upon termination:

• You must cease all use of Specimen
• You must delete all copies of Specimen from your devices
• Your license key will be deactivated
• Provisions regarding limitations of liability and disclaimers shall survive

Intellectual Property

Specimen, including its code, design, graphics, interface, and documentation, is protected by copyright, trademark, and other intellectual property laws. All rights not expressly granted are reserved by enSili.co.

The Specimen name and logo are trademarks of enSili.co. You may not use these marks without our prior written permission.

Third-Party Services

Specimen integrates with third-party services including:

• Google Fonts: Subject to Google's terms of service
• Fontshare: Subject to Fontshare's terms of use
• Paddle: Payment processing subject to Paddle's terms

We are not responsible for these third-party services, their availability, or their terms. Your use of such services is governed by their respective terms and privacy policies.

Export Compliance

You agree to comply with all applicable export and import laws and regulations. You may not use or export Specimen in violation of Spanish, European Union, or United States export laws.

Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes:

• We will update the "Last updated" date at the top of this page
• We may notify you through the application or via email
• Continued use of Specimen constitutes acceptance of updated Terms
• If you do not agree to updated Terms, you must stop using Specimen

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of Specimen shall be subject to the exclusive jurisdiction of the courts of Granada, Spain.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and enSili.co regarding Specimen and supersede all prior agreements and understandings.
